Welcome to the Empire Justice Training Center. As part of our mission, we “teach” the law and are committed to providing civil legal services providers, nonprofit advocates, and others with practical, relevant and interactive training to support their advocacy on behalf of people who are impoverished, disabled or disenfranchised. We focus on creating diverse learning environments that are interactive, accessible and engaging.

Empire Justice Center is an accredited provider of Continuing Legal Education (CLE) since 1998. Our accreditation encompasses trainings in live and virtual formats.

Foreclosure defense and mortgage loss mitigation often implicate basic real property law issues, and for some, law school’s first year property course was long ago. This session provides a refresher on such basics as the different forms of property ownership (tenancies in common, joint tenancies with rights of survivorship, tenancies by the entirety, etc.), impact of death on different forms of holding title, different means of conveyances of property (such as quit claim deeds), and an overview of New York’s recording statute.

This webinar addresses the various circumstances in which ownership of a loan can matter; explains methods for investigating the ownership of the mortgage and note; and explores what can happen, in litigation and in negotiation contexts, when ownership questions arise. The vast majority of mortgages are not maintained and serviced by their originating lenders, but are sold as collateral for securities. One result of the securitization of mortgage loans is that when securitized loans default, it is often difficult to determine which financial institution owns the loan and has the right to enforce the mortgage. Securitization can also create confusion and uncertainty about which entity is authorized to enter into modification agreements with borrowers with delinquent loans, and what rules may govern how – or whether – that loan may be modified.

This webinar will address the Federal Housing Administration (FHA) providing mortgage insurance on loans made by FHA-approved lenders throughout the United States and currently having 4.8 million insured single family mortgages in its portfolio. Loans insured by FHA are not eligible for HAMP and are instead subject to a unique set of servicing and loss mitigation rules. These rules are promulgated through a patchwork of mortgagee letters and not consolidated in a handbook. This training teaches advocates about the FHA’s unique and complex loss mitigation rules. It will also include a demonstration of MFY Legal Services Inc.’s FHA Waterfall Worksheet.
