Tucker v Toia:
First case recognizing a Constitutional right to public assistance.
The Court of Appeals, the state’s highest court, finds:
“In New York State the provision for assistance to the needy is not a matter of legislative grace; rather, it is specifically mandated by our Constitution.”
Tucker, creates the legal bedrock on which we have continued to build.
